MIANDO
General Terms and Conditions (GTC) and Consumer Information for Purchase Contracts via the MIANDO Online Shop
§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all orders placed via the MIANDO online shop by consumers and entrepreneurs worldwide.
(2) Deviating conditions of the customer will not be recognized unless MIANDO expressly agrees to their validity in writing.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person or partnership with legal capacity acting in the exercise of their trade, business, or profession.
§ 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
(2) The customer can select products and collect them in the shopping cart using the “Add to Cart” button. By clicking the “Buy Now” button, the customer makes a binding purchase offer.
(3) After submitting the order, the customer receives an automatic confirmation email. This does not yet constitute acceptance of the contract. The contract is only concluded through a separate order confirmation email or shipment of the goods.
§ 3 Product Information
(1) The essential characteristics of the goods are derived from the product descriptions in the shop.
(2) Deviations in color, shape, or processing may occur due to technical or production reasons and do not constitute a defect.
§ 4 Prices, Shipping Costs, and Delivery
(1) All prices are final prices and include statutory VAT.
(2) Shipping costs and delivery times may vary depending on location.
(3) Delivery is worldwide by shipping partners.
(4) We are not obliged to deliver if we have ordered the goods properly from our suppliers but have not received them without fault. In such cases, we will inform you immediately. Payments already made will be refunded without delay.
(5) We reserve the right to refuse or cancel orders generated automatically through software, scripts, bots, or similar programs – such as crawlers, spiders, or third-party services on behalf of the customer. Such system-generated orders are not permitted and will not be processed.
§ 5 Payment
(1) Payment can be made by advance payment, TWINT, PayPal, credit card, or instant bank transfer.
(2) Shipping will take place after full payment has been received.
§ 6 Transport Damages
(1) If goods are delivered with obvious transport damage, the customer is requested to immediately file a complaint with the carrier and inform MIANDO.
(2) Failure to make a complaint has no effect on statutory claims but makes processing with the carrier easier.
§ 7 Retention of Title
The delivered goods remain the property of MIANDO until full payment has been made.
§ 8 Warranty
(1) The statutory warranty rights apply.
(2) A guarantee only exists if expressly stated.
(3) Complaints can be directed to info@miando.ch.
§ 9 Liability
(1) MIANDO is only liable for damages caused intentionally or through gross negligence.
(2) For slight negligence, MIANDO is only liable for the violation of essential contractual obligations.
(3) There is no liability for indirect damages, particularly lost profits.

§ 11 Online Dispute Resolution
The EU Commission provides a platform for online dispute resolution:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Applicable Law and Jurisdiction
(1) Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) For consumers with habitual residence in the EU, this choice of law only applies insofar as the granted protection is not withdrawn by mandatory provisions of the country of residence.
(3) Jurisdiction is Zurich, Switzerland, as far as legally permissible.
